Sex with unconscious wife ‘no rape’

An American politician has questioned whether sex with an unconscious spouse constitutes rape.

Utah’s Republican state representative Brian Greene said sex with an unconscious person on a first date should not be allowed, but it is different for long-term relationships.

A bill that would clarify consent in sexual assault cases cleared the US House judiciary committee today, after advocates said Utah law does not fully protect victims.

Mr Greene said he feared the law would allow prosecutors to charge a man with sexual assault for having sex with his wife while she is unconscious.

He said he is worried about unintended consequences of the change.

Democratic representative Brian King of Salt Lake City said an unconscious person cannot consent, and sex in that situation is rape.
